TERMS AND CONDITIONS OF SERVICE
This license is a legal agreement between you and Innobliss Solutions Pvt. Ltd. for the use of Devourin. By downloading any Devourin files, add-ons, or resources, you agree to be bound by the terms and conditions of this license. Innobliss Solutions Pvt. Ltd. reserves the right to alter this agreement at any time, for any reason, without notice.
As part of the Service, Innobliss Solutions Pvt. Ltd. will provide the Subscriber with use of the Service, including a proprietary application, browser-based administrative interface, data transmission, access, and storage. Subscriber’s registration for, or use of, the Service shall be deemed an agreement to abide by these Terms of Use (“Agreement”) including any materials and terms available on the Innobliss Solutions Pvt. Ltd. website incorporated by reference herein, including but not limited to Innobliss Solutions Pvt. Ltd. Privacy and Security policies.
1. Permitted License & Scope of Use
- Single Domain Limit: One purchased license grants you the right to run the software on exactly one (1) production domain and unlimited development/staging sites.
- Additional Licensing: You must purchase a separate license for every additional domain that utilizes the software.
2. Explicit Prohibitions & Restrictions
- Reproduce, distribute, lease, rent, sell, sublet, or transfer the software (or parts of it) to any third party.
- Grant usage rights or sub-licenses to any other individual or entity.
- Extract components or code from the software to utilize them in outside programs.
- Use the software in violation of any applicable local, national (Indian), or international laws.
- Remove, obscure, or alter any copyright notices, proprietary markings, or logos inside the software files or the Control Panel.
3. Software Modification & Backups
- Custom Changes: You may modify, alter, or extend the software for your own internal use (or hire a third party to do so). However, you cannot resell or redistribute these modified or derivative versions.
- Backup Copies: You are permitted to make copies of the software solely for data backup purposes, provided all original proprietary notices remain completely intact on the copy.
4. Pricing, Services, and Account Accuracy
- Price Volatility: Prices for all products and services are subject to change at any time without notice.
- Service Changes: We reserve the right to modify, suspend, or completely discontinue the Service (or any specific feature) at any time without liability to you or any third party.
- Account Maintenance: You must provide current, complete, and accurate purchase data (including active email addresses and valid payment card details) and update them promptly to prevent transaction failures.
5. Technical Support & Communications
- Direct Support: Direct phone support is provided by the Company.
- Email Support: While we aim to respond to email queries quickly, the Company offers no guarantees or binding representations regarding specific response times.
6. Payment & Firm No-Refund Policy
- All Sales Final: The Company operates a strict NO REFUNDS policy on all software purchases.
- Assistance: For payment system issues or setup difficulties, contact our support team at support@devourin.com.
7. Data Privacy & Personal Information
- Data Handling: Any personal data or financial details you submit through our store or platform are explicitly governed by our separate Privacy Policy.
8. Disclaimer Of Warranty
THE SERVICE AND SOFTWARE ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. THIS INCLUDES, BUT IS NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, PERFORMANCE, QUALITY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL OPERATE UNINTERRUPTED, SECURELY, OR BE CONSTANTLY AVAILABLE.
9. Limitations Of Liability
YOU ASSUME ALL OPERATIONAL RISKS ASSOCIATED WITH INSTALLING AND USING THE SOFTWARE. IN NO EVENT SHALL INNOBLISS SOLUTION PVT. LTD., ITS AUTHORS, OR AFFILIATES BE LIABLE FOR ANY CLAIMS, LOSSES, OR DAMAGES. THIS INCLUDES PROGRAM ERRORS, HARDWARE DAMAGE, SYSTEM INTERRUPTION, LOSS OF DATA, OR LOSS OF BUSINESS PROFITS. YOU ARE SOLELY RESPONSIBLE FOR ASSESSING SOFTWARE APPROPRIATENESS.
10. Indemnification
You agree to defend, indemnify, and hold harmless Innobliss Solution Pvt. Ltd. from any third-party claims, legal suits, damages, liabilities, losses, or legal expenses (including attorney fees) that arise directly out of your misuse of the software, performance issues on your end, or your violation of any term in this license.
